The sensational “murder” trial of US Marine hero Daniel Penny in New York is one of the worst miscarriages of justice that Americans have ever seen. When a crazed drug addict on board the subway threatened to kill other passengers, Penny put him in a chokehold. The dangerous, crazy guy—Jordan Neely—later died in the ambulance on his way to the hospital. Penny is now on trial facing second-degree murder charges. As the prosecution made its case against him this week, the doctor who declared the case to be a murder made a shocking admission on the witness stand.

Dr. Cynthia Harris is a forensic pathologist in the New York City Medical Examiner’s Office. Harris initially wrote the word “inconclusive” as the cause of death on Neely’s death certificate. The day after that, on May 2, 2023, she wrote the words “pending further study.” There were still unanswered questions at that point.

In a normal death investigation, Dr. Harris would have waited until the toxicology results came back. But then she saw the cellphone video of Daniel Penny subduing Jordan Neely. She immediately wrote on the death certificate that Neely died from “asphyxiation” because of Penny restraining him in a chokehold. Daniel Penny is a heroic white man and Jordan Neely was a disgusting and dangerous hobo with a lengthy criminal record—who happened to be black.

People in Generation Z and younger have no idea how good race relations used to be in this country. Up until a gay crack smoker named Barack Obama was elected in 2008, most people in this country judged others based on the content of their character, rather than the color of their skin.

Pre-2008, this case never would have made it to trial. It would have been dismissed as self-defense on the grounds that Daniel Penny stepped in to protect the women on the subway that Jordan Neely was threatening to kill. But ever since Obama injected racial hatred back into our politics, liberals automatically divide society up into Good People and Bad People in every situation.

Good People are anyone whose skin color is not white. Bad People are whites and also those pesky Japanese who get high test scores in school. Dr. Harris didn’t wait for Neely’s toxicology report because she had made up her mind based on a cellphone video of Penny restraining him. Jordan Neely was a Good Person because he was black and Daniel Penny was a Bad Person because he was a straight white male. Case closed.

The toxicology report, by the way, came back showing that Neely had a huge concentration of K2 in his system. That’s a newer cannabinoid that is 100 times more powerful than marijuana and acts as a massive stimulant like cocaine. Neely didn’t have any marks on his throat, so medical examiners initially thought he must have died from cardiac arrest.

Dr. Harris says the toxicology report wouldn’t have changed her mind on the cause of death.

“No toxicological report would change my opinion,” she admitted on the witness stand. “He [Neely] could have come back with enough fentanyl to kill an elephant and walked onto the train and got put in a chokehold, and that’s how he died.”

In other words, she is a closed-minded liberal and she knows who the Good Person and the Bad Person are in the tragic death of Jordan Neely. This case should never have made it to trial. Racial identity politics have poisoned our judicial system. The New York City jury is undoubtedly going to find Daniel Penny guilty, despite his heroic actions to protect other civilians from a dangerous drug addict.

Unless the jury surprises us by doing its duty, President-Elect Trump should pardon Daniel Penny on his first day in office.
